This document sets out the rules for using the FaxTelecom website and the conditions on which its paid services are bought. It binds Dim Solution, the company running the service, and anyone — private individual or business — who browses the site or submits a fax through it.
Submitting the sending form means accepting these terms as published on that day. If any of them is a problem for you, please do not use the service: since nobody signs up, there is nothing to cancel.
Below, “you” is the person using the site; “we” and “FaxTelecom” refer to Dim Solution, the publisher of the service.
1. What FaxTelecom does
FaxTelecom delivers a PDF uploaded from a web browser — on a computer, tablet or smartphone — to a fax machine. There is no account to open and no software to install.
- Countries served. Landlines in Belgium, Canada, France, Germany, Italy, Portugal and Spain. Numbers are typed in the national format of the chosen country. Mobile numbers are out of reach of fax.
- File. One PDF per transmission, up to 100 MB. A cover page built from the form fields is placed in front of it.
- Prices. One page: free, with no quota. Two pages or more: a paid transmission, priced in section 4. PDF acknowledgments of receipt are a separate paid option.
- Limits. FaxTelecom does not issue fax numbers and does not receive faxes. Your pages carry no advertising.
2. Access and how a transmission runs
The site is open to anyone with an internet connection; the equipment and subscription this requires are your own responsibility. Every transmission follows the same path:
- you fill in the form — your name and email address, the recipient’s name and number, the subject, the cover-page message — and attach your PDF;
- if the document has more than one page, you pay for the transmission at this point;
- you receive an email whose link has to be clicked within three minutes, otherwise the request is not sent;
- a countdown of about 55 seconds starts, during which you can still stop it;
- the fax goes out and its tracking page shows the status, refreshed every five seconds.
Most transmissions finish within a minute or two, longer at busy times. We work to keep the site available but cannot promise uninterrupted access: maintenance, a carrier outage or force majeure can suspend it. Such interruptions give no right to compensation; section 4 still governs paid services.
We may block a transmission, or a user’s access, where the use made of the service breaches section 3.
3. Permitted and prohibited uses
FaxTelecom is for getting a document to a recipient who expects it or has a legitimate reason to receive it: paperwork for a public office, a prescription for a pharmacy, a purchase order for a supplier.
The following are prohibited in particular:
- marketing faxes sent to an individual who has not agreed to them beforehand (Article L34-5 of the French CPCE), and more broadly any bulk mailing the recipients did not ask for;
- unlawful content: defamation, insults, threats, incitement to hatred, infringement of intellectual property, invasion of privacy;
- impersonation, a false sender name, or somebody else’s email address;
- sending third parties’ personal data without a legal basis, or information covered by a secrecy obligation you are not entitled to lift;
- driving the form with bots or scripts, getting around technical limits, or any attempt to disrupt the service.
What you send and the number you type are your responsibility alone. Once a fax has gone to the wrong number, there is no calling it back: check before you confirm.
4. Terms of sale
This section governs the site’s two paid services; the other sections cover anything it leaves out.
Seller: Dim Solution (FaxTelecom) — 73 rue Victor Hugo, 77340 Pontault-Combault, France — SIRET 824 358 741 00018 — contact@faxtelecom.com.
4.1 Multi-page faxes
- Price. €3.99 including VAT per fax, whether the PDF has 2 pages or 200 — €3.33 before tax plus €0.66 of French VAT at 20%. A one-page fax remains free.
- When you pay. The amount is displayed and paid when you submit the form, before the confirmation email. Until the payment is authorized, your document is held aside and goes nowhere.
- When the money is taken. Your card is first only authorized. The charge happens when you confirm the transmission through the link in the email. If you never confirm, nothing is taken and the authorization lapses on its own within seven days at most.
- Fax not delivered. The charge comes before the transmission. If the fax does not get through — busy or dead line, no fax machine on the line, technical incident, cancellation during the countdown — the refund is not triggered automatically: email contact@faxtelecom.com with the transmission number. Once the tracking page shows the fax was not delivered, the full amount is credited back to the card you used.
4.2 PDF acknowledgments of receipt (option)
- What you get. Two PDFs for a given fax: the request acknowledgment, proving we received and checked your request, and the transmission acknowledgment, which records the number dialled and when the fax got through. The fax travels in exactly the same way with or without this option.
- Price. €2.99 including VAT per fax — €2.49 before tax plus €0.50 of VAT at 20%.
- No delivery, no charge. Your card is authorized when you order; the money is taken only if the transmission succeeds. If it fails or you cancel it, the authorization is released, nothing is taken, and an email tells you so. Should an authorization fail to be released, it lapses within seven days anyway.
- Delivery. You get the request acknowledgment by email once you have clicked the link and the authorization has gone through, then the transmission acknowledgment when the fax arrives. The tracking page lets you download them again, except after a full refund.
4.3 Payment
Payment is by card, in a secure Stripe module embedded in the page. You enter your card details with Stripe: FaxTelecom cannot see them and does not store them. A payment session left open expires after one hour. Prices are in euros, all taxes included; an invoice is issued on request.
4.4 Right of withdrawal
A consumer normally has fourteen days to change their mind about a purchase made at a distance. Both services above, however, are carried out straight away, at your request:
- sending the fax is a service completed in full the moment it is transmitted, a case in which French law rules out withdrawal (Article L221-28, 1°, of the Consumer Code);
- the acknowledgments are digital content supplied without a physical medium, likewise excluded once supply has begun (Article L221-28, 13°).
Before paying, you tick a box asking for this immediate performance and expressly waiving your right of withdrawal; until it is ticked, payment cannot start. Up to the moment you click the confirmation link you stay in control: without that click, nothing is charged.
4.5 Complaints
For any payment issue — an unexpected charge, a missing acknowledgment, a paid fax that was not delivered — email contact@faxtelecom.com with the transmission number. Any amount taken without the matching service being provided is refunded.
5. Liability
We use reasonable means to deliver every fax; this is a best-efforts commitment, not a guarantee of result. The outcome also depends on things outside our control — the recipient’s line, the state of their fax machine (switched on, paper loaded, memory free), how legible the PDF is, the carriers’ networks.
FaxTelecom is not responsible for:
- a fax sent to a mistyped number;
- the content of documents, for which the sender alone answers;
- what the recipient does with the fax they receive;
- the consequences of a delay: for a document with a deadline, send it early enough and keep proof of transmission;
- the confidentiality of the telephone leg between our servers and the fax machine, which the fax protocol does not encrypt, whatever service is used.
Where we are found liable, compensation covers only direct and foreseeable loss, up to the price paid for the transmission concerned. This cap does not apply to gross negligence or wilful misconduct, to personal injury, or where the law forbids it towards a consumer.
If a third party claims damages from us because of a fax sent in breach of section 3, you will cover any sums we are ordered to pay.
The site’s information pages — guides, glossary, dialling codes — are written with care but are no substitute for legal or technical advice suited to your situation.
6. Personal data
To send a fax, we process the form fields, the document and a few technical data. The PDF travels encrypted (HTTPS) to our servers, is used for the transmission only and is erased automatically afterwards.
The details — which data, why, on what legal basis, for how long, which processors, and how to exercise your rights — are set out in the privacy policy.
If your document contains information about other people, it is up to you, under the GDPR, to make sure you may pass it on to the recipient.
7. Intellectual property
The FaxTelecom name, logo, visual identity, texts, illustrations and site code belong to Dim Solution or its licensors. Reproducing or reusing them, in whole or in part, without written consent is prohibited, except where the law allows it, such as a short quotation that names its source.
The free tools — cover-page generator, dialling-code directory — may be used freely for your own needs; the PDFs you produce with them are yours.
You keep every right in the documents you send. You only allow us to process them for as long as their transmission requires.
Links to any public page of the site are welcome, provided they do not suggest a partnership that does not exist.
8. Changes to these terms
These terms may change, for instance when a feature or a price does. Each transmission is governed by the version published when you submit it; a new version never applies to a transmission already paid for. The date of the last update appears at the top of the page.
9. Governing law, mediation and disputes
These terms are governed by French law. A consumer living in another EU member state keeps the protection of the mandatory rules of their country of residence.
If you disagree with us, start by writing to contact@faxtelecom.com: most issues are settled that way.
Consumer mediation. If your written complaint does not get a satisfactory answer, you may refer the matter free of charge to a consumer mediator, as provided for by Articles L611-1 et seq. of the French Consumer Code, within one year of that complaint. The contact details of the competent mediator are sent on request to the same address.
Failing an amicable settlement, the dispute goes before the French courts. A consumer may choose between the court for the place where they lived when the contract was made and the court for the place where the harm occurred. Between businesses, the courts of Melun have exclusive jurisdiction.
